Definitions

The Wood Buffalo Adventure Club (WBAC) is a group of like-minded individuals who share an interest in the pursuit of low impact outdoor recreational activities. A WBAC Event is defined as starting at the trailhead where group assembles to commence the activity and ends when the group arrives at the planned trail end. Events are not guided by members. Neither the WBAC nor its Members represent that they have any specialized training or skills relating to Events, wilderness safety or first aid. WBAC and its members are not responsible for explaining risks involved with participating in Events.

In consideration of being allowed to participate in the WBAC programs, related events and activities, the undersigned acknowledges, appreciates and agrees that:

  1. I understand the risks, hazards, and dangers that wilderness adventures involve, all of which cannot be listed here. Among the more obvious and frequent are but not limited to:
    • Exposure to variable extremes in weather that may cause injury due to heat or cold, and which may prevent or force route and itinerary changes.
    • Contact with and/or possible immersion in cold water for undetermined periods, leading to hypothermia and/or possible suffocation.
    • Unfamiliar terrain and routes where hikers could become separated
      from the party.
    • Transport by public or private motor vehicle, helicopter or fixed wing aircraft.
    • Remote locations with poor communications and inability to get rescue or medical assistance easily or quickly.
    • Wildlife, domestic animal or insects are unpredictable and could become a threat, attack, spread diseases, cause injury or death.
  2. I am not relying on any oral or written statements made by the WBAC, or its agents, whether in brochure, advertisements or in individual conversation to lead me to become involved in this program on any basis other than my assumption of the risks involved.
  3. I am voluntarily participating and agree to accept all of the risks and the possibility of death, personal injury, property damage and/or loss resulting from my involvement with the course or Event. I am undertaking with the WBAC. I understand and acknowledge that I am responsible for making myself aware of all such risks and accept and assume complete responsibility for all such risks.
  4. I, on behalf of myself, my estate. my next of kin, my heirs, executors, administrators and assigns hereby release the WBAC, its officers, volunteers, employees, guides, agents and representatives from any and all liability for any personal injury, death, property damage or loss I may suffer as a result of my participation in their Events, or course, for any cause whatsoever including negligence on the part of the WBAC, its officers, volunteers, employees guides, agents or representatives.
  5. I certify that I am physically capable and fit to participate in this activity and assume the responsibility for my physical fitness and the capacity to undertake such activities.
  6. I certify that I have the degree of skill and knowledge necessary for me to engage in these activities safely.
  7. I, hereby consent that the photographs taken of me by the WBAC may be used or sold in whole or in part by the WBAC for the purpose of advertising or publication in any manner.
  8. Should the WBAC or anyone acting on their behalf, be required to incur lawyer’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
  9. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

I confirm that I have read over this agreement, that I understand it and that it will be binding on myself, my estate, my heirs, my next of kin, my executors, administrators, and assigns.

I agree that the laws of the Province of Alberta govern this contract.
